Little Pim website (“Websites”) and mobile applications (“Apps”) are operated by Little Mangos, LLC d/b/a Little Pim (“Little Pim,” “us,” or “we”). Access and use of the service is subject to the following Terms and Conditions of Service (“Terms and Conditions”). The Service allows users to access and use a variety of language learning videos.  Little Pim may, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently.

By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. Little Pim may amend, update or change these Terms and Conditions. If we do this, we will post a notice that we have made changes to these Terms and Conditions on the website for at least 7 days after the changes are posted and will indicate at the bottom of the Terms and Conditions the date these terms were last revised. Any revisions to these Terms and Conditions will become effective the earlier of (i) the end of such 7-day period or (ii) the first time you access or use the Service after such changes. License to use the service

Unless otherwise stated, Little Pim, Inc and/or its licensors own the intellectual property rights published on this service and materials used on www.littlepim.com.  Subject to the license below, all these intellectual property rights are reserved. You must not:

  • provide on or through the Service any content that: (i) is libelous, defamatory, abusive, threatening, harassing, hateful, offensive or otherwise violates any law or infringes upon the right of any third party (including copyright, trademark, privacy, publicity or other personal or proprietary rights); or (ii) in Little Pim’s sole judgment, is objectionable or which restricts or inhibits any other person from using the Service or which may expose Little Pim or its users to any harm or liability of any kind;

  • sell, rent or sub-license material from the service;

  • show any material from the service in public;

  • reproduce, duplicate, copy or otherwise exploit material on this service for a commercial purpose;

  • republish or reproduce any part of this service through the use of iframes or screenscrapers;

  • where content is specifically made available for redistribution, it may only be redistributed within your organization

Little Pim accepts no liability for any disruption or non-availability of the service resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restriction and censorship.   

Nothing on this service constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any legal, financial or medical matter you should consult an appropriate professional.

Payment Processors

All financial transactions made in connection with the Service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no event will Little Pim be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages.

Refund Policy

In the event that Little Pim suspends or terminates your use of the Service or these Terms and Conditions or you close your account voluntarily, you understand and agree that you will receive no refund or exchange of any kind, including for any unused virtual currency or other Virtual Item, any Content or data associated with your use of the Service, or for anything else.

Limitations of liability

Little Pim will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this service:

  • to the extent that the service is provided free-of-charge, for any direct loss;

  • for any indirect, special or consequential loss; or

  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

Exceptions

Nothing in this service disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this service disclaimer will exclude or limit the liability of Site Title in respect of any:

  • death or personal injury caused by the negligence of Little Pim. or its agents, employees or shareholders/owners;

  • fraud or fraudulent misrepresentation on the part of Little Pim

By using this service, you agree that the exclusions and limitations of liability set out in this service disclaimer are reasonable. If you do not think they are reasonable, you must not use this service.

Breaches of these terms and conditions

Without prejudice to Little Pim’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Little Pim may take such action as Little Pim  deems appropriate to deal with the breach, including suspending your access to the service, prohibiting you from accessing the service, blocking computers using your IP address from accessing the service, contacting your internet service provider to request that they block your access to the service and/or bringing court proceedings against you.

Trademarks

“Little Pim” and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or service marks of Little Pim or their respective owners, and certain of them are registered with the United States Patent and Trademark Office. Access and use of the Service does not grant or provide you with the right or license to reproduce or otherwise use the Little Pim name, service marks, graphics or logos.
